These activities seek to lead to the production of a far-reaching study on existing good practice that alleviate the burden of proof in ML investigations and asset recovery procedures. The results of the study shall provide a valuable resource for the work of relevant global and regional institutions (e.g. FATF\, FSRBs\, EU and UN relevant structures etc.)\, as well as national authorities and justice sectors. \nGeneral Prosecutor of Romania Gabriela Scutea opened the session on Monday\, stating “We need  to help develop new innovative instruments to combat ML and terrorist financing (TF) worldwide. I am trusting that the result of this collaborative work will be helpful and inspire legal practitioners not only here in Romania but also in many countries of the world.” \nFor his part\, EU Global Facility Team Leader David Hotte noted in his opening remarks: “Today\, we need to find a solution to combat ML/TF in an ever more efficient way that is useful for all but also constitutional and in respect of human rights.” \nDuring this specific session\, experts worked to identify\, in their domestic law\, one or several legal mechanisms (legislative provision\, rule established by consolidated case law\, administrative mechanism\, etc.) which facilitate satisfying the reversed burden of proof in ML and cases of illicit enrichment offence. \nPresident of the Siracusa Institute\, Jean-François Thony\, stressed the importance of the matter\, saying “the experts meeting today have one question to answer: how can we improve the fight against money laundering and terrorist financing and how can we ensure that criminals engaging in that kind of activities can be sentenced and deprived of their ill-gotten assets\, within the respect of constitutional rights?” \n“All practitioners know that the difficulty of providing evidence of the offence of money laundering is more acute than for any other crime\, because the essence of this offence is precisely to hide evidence\, to make the trail of illicit profits untraceable\, and to protect criminal assets from confiscation\,” he added. \nThe Experts Working Group is part of a series of activities organised by the EU GF-AML/CFT and the Siracusa Institute aimed at strengthening international judicial co-operation and the efficient application of existing MLA standards and international instruments by judges and prosecutors.[/vc_column_text][/vc_column][/vc_row][vc_row type=”in_container” full_screen_row_position=”middle” column_margin=”default” column_direction=”default” column_direction_tablet=”default” It will provide regulators of NPOs\, FIUs and NPO Associations with a platform to discuss and share insights on best practices and challenges which they face and methodologies that can be used to ensure compliance with the FATF requirements on NPOs. Such exchanges will contribute towards prioritisising the improvement of national legislation and policies that will promote accountability\, integrity and public confidence in the administration and management of NPOs. The Workshop will also assist member countries to implement respective FATF ICRG Action Plans or any other follow-up processes in relation to Recommendation 8.[/vc_column_text][/vc_column][/vc_row]

It seeks to allow regulators from Non-Profit Organisations (NPOs) and representatives of Financial Intelligence Units (FIU) to exchange best practices and challenges faced among themselves and with the EU and other states on the applied methodology\, chosen policies and work undertaken to ensure compliance of their legislation and practice with FATF Recommendation 8 requirements. \nThe event will also provide a tangible opportunity to proceed with concrete steps to promote effective supervision of NPOs and ultimately assist in relevant mutual evaluation assessments in relation to the said recommendation by the participating states. On the last day of the workshop\, the Global Facility will also present its recent research report titled “Typologies of the Illicit Financial Abuse of NPO Sector – Specificity\, Complexity\, Complicity and Harm”. \nIn his keynote address to the audience\, Minister of Financial Services and Good Governance\, Hon. Mahen Kumar Seeruttun thanked the EU Global Facility for its “unwavering support to Mauritius at all times\,” noting that “the EU Global Facility has provided us with technical assistance whenever requested\, providing us with the highest quality of support and experts.” \nTeam Leader of the EU Global Facility\, David Hotte\, congratulated Mauritian partners on the successful delisting from the FATF grey list in October 2021\, saying “we are very proud to have contributed\, along with other international partners like GIZ\, the UK\, IMF and the UN\, among others\, to the delisting of Mauritius and we will continue working together even after this milestone. It is only the beginning of a new and promising era.” \nFor his part\, Ambassador and Head of the EU Delegation\, H.E. Vincent Degert\, commended the government\, civil servants and public sector of Mauritius\, stating “the government has repeatedly expressed its wish to address all ESAAMLG recommendations and to improve all their immediate outcomes scores\, thus to become a role model for many countries worldwide.” \n“I can only felicitate this attitude as it is very important that the current momentum for reform is maintained\, to make these achievements sustainable and far-reaching\, building on the very relevant tools that were developed with the help of the EU Global Facility assistance and of the other international donors and continuing their capacity building to be able to reach concrete results.” \nThe workshop is part of a series of activities organised by the EU Global Facility in Mauritius from November 16 to 25th\, 2021.[/vc_column_text][/vc_column][/vc_row][vc_row type=”in_container” full_screen_row_position=”middle” column_margin=”default” column_direction=”default” column_direction_tablet=”default” column_direction_phone=”default” scene_position=”center” text_color=”dark” text_align=”left” row_border_radius=”none” row_border_radius_applies=”bg” overlay_strength=”0.3″ gradient_direction=”left_to_right” shape_divider_position=”bottom” bg_image_animation=”none”][vc_column column_padding=”no-extra-padding” column_padding_tablet=”inherit” column_padding_phone=”inherit” column_padding_position=”all” column_element_spacing=”default” background_color_opacity=”1″ background_hover_color_opacity=”1″ column_shadow=”none” column_border_radius=”none” column_link_target=”_self” gradient_direction=”left_to_right” overlay_strength=”0.3″ width=”1/2″ tablet_width_inherit=”default” tablet_text_alignment=”default” phone_text_alignment=”default” bg_image_animation=”none” border_type=”simple” column_border_width=”none” column_border_style=”solid”][nectar_cta btn_style=”see-through” heading_tag=”h6″ button_color=”default” link_type=”regular” alignment=”left” alignment_tablet=”default” alignment_phone=”default” display=”block” link_text=”Learn more about our work with Mauritius” url=”https://dev.global-amlcft.eu/where-we-work/mauritius-aml-cft/”][/vc_column][vc_column column_padding=”no-extra-padding” column_padding_tablet=”inherit” column_padding_phone=”inherit” column_padding_position=”all” column_element_spacing=”default” background_color_opacity=”1″ background_hover_color_opacity=”1″ column_shadow=”none” column_border_radius=”none” column_link_target=”_self” gradient_direction=”left_to_right” overlay_strength=”0.3″ width=”1/2″ tablet_width_inherit=”default” tablet_text_alignment=”default” phone_text_alignment=”default” bg_image_animation=”none” border_type=”simple” column_border_width=”none” column_border_style=”solid”][nectar_cta btn_style=”see-through” heading_tag=”h6″ button_color=”default” link_type=”regular” alignment=”left” alignment_tablet=”default” alignment_phone=”default” display=”block” link_text=”See pictures of the event” url=”https://dev.global-amlcft.eu/images-videos/”][/vc_column][/vc_row]
