This will serve to discuss the specific features and mechanisms through which beneficial ownership information can be registered\, vetted and enforced. \nAdriana del Pilar Solano Cantor\, Deputy Director of the Tax Registry Administration in Colombia\, stated that “This workshop will enable Colombia to identify good practices for the deployment of such beneficial ownership registries\, the existing opportunities for improvement of the regulatory framework and IT system in Colombia and the development of new features in the registry such as the registration of the chain of ownership and control. Similarly\, this exchange of experience will also serve to identify areas of improvement in the technical framework”. \nFor his part Alexandre Taymans\, Key Expert of the EU Global Facility on Beneficial Ownership\, celebrated the launch of this first beneficial ownership training in Colombia. He noted the fact that Colombia already had an operational beneficial ownership registration system and good understanding of the issues that it will face\, both in terms of ensuring the availability\, quality and accessibility of the information\, which will ensure very fruitful discussions and exchanges. He also indicated that beyond the training and exchange of experiences\, this activity was also aimed at identifying areas of future cooperation in areas where the expertise of the Global Facility could be deployed to support Colombian authorities. \nOn Thursday\, other competent authorities from Colombia will attend a session focusing on international standards and best practices on the topic of Beneficial Ownership as well as the tools that can be developed to enhance the understanding of BO disclosure requirements. \nThe sessions will also cover the verification and supervision mechanisms that can be implemented by jurisdictions to ensure that frameworks are effectively implemented by both private and public sector stakeholders.[/vc_column_text][/vc_column][/vc_row]

A number of stakeholders from the AMLU\, the Central Bank of Jordan and the Companies Control Department along with competent authorities have worked together on designing and implementing the assessment of the AML/CFT risks and the misuse of legal persons and legal arrangements\, using a leading-edge methodology. \n  \nIn her opening remarks\, Head of the Anti-Money Laundering Unit of Jordan\, Samya Abu Sharif\, noted: “the topic of today’s workshop is an indication of the important role of all national agencies in promoting the necessary actions to combat the risks of money-laundering and terrorist financing associated with legal persons and legal arrangements at the national level.” \n“Understanding the potential threats\, and strengthening the system to achieve increased transparency for the legal persons and the legal arrangements and developing national programmes in partnership with the private sector to reduce their impact is a crucial objective of thjs assessment work.”  \n“The results of the assessment presented today will help us better understand and be directed towards high-risk aspects in order to prevent criminals from exploiting legal persons and legal arrangements in ML/TF crimes\,” she added. \nFor his part\, EU Global Facility Key Expert on Beneficial Ownership Alexandre Taymans commended the “successful work and important efforts put together by Jordan to conduct this exercise in such a structured and timely manner”. \n“As the dissemination of the findings of this assessment are now launched\, such a milestone calls for and paves the way for an enhanced engagement between competent authorities\, as well as with the private sector to ensure that the recommendations and the mitigating measures identified by the working group will be fully implemented before the next update to the risk assessment\,” he stated. \nThe EU Global Facility has developed a dedicated methodology for the risk assessment of legal persons and arrangements to assist partner jurisdictions with a methodology that can be tailored to their specific context. \nThis activity is a milestone for any country implementing a BO disclosure framework as it will help them identify the risk jurisdictions are facing from the misuse of legal vehicles both at national and international level. areas of improvement and possible mid-term activities to be delivered by the Global Facility (e.g. development of the legal framework\, its implementation\, risk based approach to BO The EU Global Facility will therefore continue its ongoing work in this domain.” \nOur Key Expert on Beneficial Ownership Alexandre Taymans\, described the work being carried by the project with partner countries and organisations\, which includes bringing together experts from the public and private sector\, as well as civil society representatives. He emphasised that “the composition of the panel and the wide range of expertise put together today\, is a reflection of the multi-stakeholder engagement and enforcement strategies that will inevitably be required for BO disclosure systems to be made effective”. \nHe discussed the follow-up work to be conducted in this domain\, which will involve discussing measures to address and reduce the risk of complexity affecting beneficial ownership transparency.[/vc_column_text][/vc_column][/vc_row]

In this way\, it will defend itself against the influence of organised crime on its institutions and can protect the interests of the state and the nation.” \nThe regional event aims to allow participants to exchange and further their expertise on FATF standards on availability and accessibility of beneficial ownership information\, the assessment of money laundering and terrorism financing risks associated with the misuse of legal persons and arrangements in the GAFILAT region\, the design and implementation of mitigation measures as well as emerging trends and specific topics related to the ever increasing importance of beneficial ownership transparency throughout jurisdictions across the world. \nIn his welcoming remarks\, EU GF Team Leader David Hotte\, thanked the GAFILAT and Panamanian authorities for their support\, noting: “we are particularly happy to see such a high level of attendance in this first regional conference the EU Global Facility is organising in Latin America. Malta was represented by Dr Geraldine Spiteri Lucas from the MBR and Mr Alfred Zammit from the FIAU. \n“Our ultimate goal is to ‘handbook’ tangible proposals and best practices that can be made available to stakeholders and jurisdictions who are seeking to build or enhance national beneficial ownership capabilities\,” explained EU Global Facility Key Expert on Beneficial Ownership Alexandre Taymans\, noting that “the purpose of these sessions is to delve deeper into the topic\, discuss challenges and lessons that can be learnt and applied for technical assistance to the benefit of the EU GF partner countries. This way we can put forward an approach for more effective national and cross border beneficial ownership disclosure frameworks.” \nFor her part Dr Geraldine Spiteri Lucas\, MBR Chief Executive Officer\, explained Malta’s experience in arriving where it is today\, which is having an accurate and an up-to-date Beneficial Ownership Register. ‘The effectiveness of the BO Register revolved around accuracy and accessibility by competent authorities and subject persons. Most importantly\, it is crucial to have all the entities work together hand in hand. It is indeed of great pleasure for Malta to have welcomed representatives from registries across Europe discussing a subject that is dominating amongst registers fora’ said Dr. Spiteri Lucas. \nAlfred Zammit\, Deputy Director at the Financial Intelligence Unit of Malta\, explained that Beneficial Ownership registries are becoming an increasingly important component in the fight against ML/FT\, but transitioning from a registry to a competent authority is easier said than done. Attendees included representatives from the Anti-Money Laundering Unit\, the Central Bank of Jordan\, the Companies Control Department and the Jordan Free and Development Zones Group. \nThe workshop focused on \n\n(i) the finalisation of the draft BO Regulation that the Global Facility has been working on with Jordan and\n(ii) the identification and planning of the upcoming activities related to the implementation of this Regulation (e.g. outreach activities for the FI/DNFBP sectors\, supervisors and legal vehicles in scope).\n\nFollowing the workshop\, meetings were held with the head of the AMLU and the Controller of the Companies Control Department to discuss the forthcoming activities to be organised by the EU Global Facility in Jordan. These Guidelines and Handbook will be extensively discussed with the BoM as well as other supervisors (e.g.\, FSC\, FIU\, AGO\, MIPA) and their obliged entities under supervision during the course of the workshop. \nPress Communiqué of the activity: \nFinancial Services: Workshop to reinforce capacity of financial institutions supervisors \nOur team led by Arnaud Stien and Alexandre Taymans led discussions focused on the key features and challenges of international and EU BO standards\, outreach tools that can be implemented as well as supervisory and sanctioning mechanisms available.
