A prosecutor from Andorra specialised in AML/CFT (and former FIU official) will explain the experience of Andorra: the evolution and situation of jurisdictions that have had a recent definition of tax crime in their jurisdictions and the changes and challenges that this has implied and still implies\, in the internal and international sphere. \nOn the other hand\, the activity will refer to the strategies that can be carried out in relatively small jurisdictions or of moderate dimensions in relation to the prosecution of money laundering from tax crime\, particularly in the case of regional or international financial centres. \n\nPress Release\nEU Global Facility\, National Commission Against Money Laundering of Panama hold training on tax offense investigation\nPanama City/Brussels\, 19 July 2022 – A virtual training on “Investigation of Money Laundering with a tax offense committed abroad as a predicate offense” was launched today\, through a collaboration between the EU Global Facility on Anti-Money Laundering and Countering the Financing of Terrorism (EU GF-AML/CFT) and the National Commission against Money Laundering\, Financing of Terrorism and Financing of the Proliferation of Weapons of Mass Destruction (CNBC) of Panama. \nTargeted at representatives of the judiciary\, Public Prosecution\, the Directorate of Judicial Investigation\, the Financial Analysis Unit -UAF\, the General Directorate of Revenues. Ministry of Economy and Finance and\, as a national coordinator\, the CNBC\, the training is witnessing the participation of some 50 officials over the course of three days. \n“In the last years\, Panama took a number of important steps to conform its tax system to the highest international standards. The EU welcomes Panama’s reforms and progress on enhancing its legal and transparency standards by providing technical assistance through the EU GF-AML/CFT\,” said Adolfo Campos\, Political Adviser at the EU Delegation in Panama in his welcoming remarks. \nFor her part\, Isabel Yadira Vecchio\, Technical Secretary of the CNBC of Panama and National Coordinator for GAFILAT\, stated: “Panama has developed constant strategies to promote\, protect and defend our economy from the challenges it faces\, as part of the changing world in which we live. In this sense\, we have redoubled efforts with a view to promote not only regulatory changes at the forefront of the global movement\, but also to achieve positive and tangible results that guarantee we can strengthen our AML system.” \nThe online training is part of a series of activities organised by the EU GF-AML/CFT to support Panama in rectifying deficiencies in its AML/CFT frameworks and upholding its compliance standards in this regard. More specifically\, the technical assistance focuses on Panama’s fulfilment of the immediate results 5 and 7 of the Financial Action Task Force as adapted to the needs and priorities established by Panama. \nThe virtual course is intended to be followed by an onsite activity later on\, where the issues of ML and tax crime committed abroad as well as the importance of international cooperation in combating those crimes will be addressed.[/vc_column_text][/vc_column][/vc_row]

The EU Global Facility’s multistakeholder strategy to (i) enhance BO disclosure regimes and their effectiveness\, and (ii) increase national\, regional and international cooperation and networks on AML/CFT;\n???? The business and technical requirements and operational aspects to consider when setting up a beneficial ownership registry;\n???? The possible mechanisms aimed\, during the different phases of a BO Register implementation\, at ensuring that the beneficial ownership information is accurate and up to date as well as timely accessible.\n\nFollowing these sessions\, the event included an open discussion where practical case studies were discussed to highlight some of the points discussed in the morning. These included: \n\n\n\n-The steps and elements to consider when designing and implementing a BOR (stakeholder engagement\, procurement\, monitoring)\n-What are the control and verification mechanisms that can be implemented\, and at what stage of the BOR implementation\n-Exchange of country experiences from North Macedonia\, Latvia\, Ghana\, Kenya.\n\n\n\n[/vc_column_text][/vc_column][/vc_row]

In particular\, we are exploring the possibility of Beneficial Ownership Registers evolving into Competent Authorities. \nIn this context\, the Global Facility organised a working group of experts who deal with these issues first-hand. The purpose of the event was to delve deeper into the topic\, discuss challenges and lessons learnt and put forward an approach for more effective national and cross border beneficial ownership disclosure frameworks.\nThe session involved only a small number of participants from Beneficial Ownership Registers and FIUs\, creating an opportunity to meet\, network and exchange ideas with colleagues on a very topical matter. \n  \nIn their words:\nAlfred Zammit\, Deputy Director at the Financial Intelligence Unit of Malta\, reflects on the activity: \n“It was a pleasure for me to be able to contribute to the interesting discussions that we had in Brussels\, and to share Malta’s experiences and best practices on the topic of beneficial ownership\,” he stated after the workshop. \n“It was also interesting and useful to hear about the experiences\, practices and challenges faced by our international colleagues from FIUs and BO registries\, possible solutions\, and above all\, the different approaches implemented on the ground. There’s always so much to learn from each other. Bringing together several representatives from EU member states to have thought-provoking discussions on this topic in a frank and informal setting was a commendable initiative\, and a great way to launch this project.” \n“I hope we can continue to assist you with this project\, and we look forward to its outcome. I have no doubt that the international AML/CFT community will find the guidance and assistance that will come out of this project incredibly useful to strengthen their framework when it comes to BO.”[/vc_column_text][/vc_column][/vc_row]

In the past years\, Egypt has taken numerous measures to identify\, investigate and tackle this type of trafficking\,” said Judge Ahmed Said Khalil\, Chairman of the Board of Trustees – AML/CFT Unit of Egypt. \nHe added: “Over the past 7 years\, 29\,000 antiquities have been recovered by the Arab Republic of Egypt\, in collaboration with relevant entities and institutions in partner countries including France\, Germany\, Jordan\, the US\, Mexico (among many others).”  \nThe first in a series of four regional conferences to be organised through 2024\, the event will consist of a series of presentations by international experts on money laundering\, terrorist financing and illicit art trafficking\, as well as a hands-on case study examining the routes and and methodologies used by criminal networks involved in the looting or theft of antiquities and art. \n“Today’s conference is an important building block in fighting criminality in art and antiquities.  The EU Global Facility is a crucial project in the fight against ML/TF in all its forms\, including the trafficking of art and antiquities. With the presence of delegates from 14 countries\, the EU and the UN will certainly bring a wealth of experience in art and antiquities investigations. More importantly it will allow identifying potential solutions and recommendations to be brought to the next conference\,” said Christian Berger\, EU Ambassador to Egypt. \nUltimately\, the conference will aim to build the capability of both public and private sectors to share information\, identify problems and solutions to this type of crime. It also seeks to raise awareness of the issues\, and increase the capability of all actors involved to reduce and counter the ML/FT penetration of these lucrative markets and protect a country’s heritage.[/vc_column_text][/vc_column][/vc_row][vc_row type=”full_width_background” full_screen_row_position=”middle” column_margin=”default” column_direction=”default” It forms part of wider joint work currently conducted by the ESAAMLG to develop a toolkit aimed at assisting their members in assessing the risk related to the misuse of legal persons and arrangements for money laundering and terrorism financing purposes. \n“This session has been designed to build the foundation of the future activities that will be conduct in the coming weeks and that will more specifically focus on the ways in which jurisdictions can conduct their risk assessment of LP/LA\,” said Alexandre Taymans\, EU GF Key Expert on #BO. \nThis activity will also feed in other activities to increase awareness and understanding of how beneficial ownership opacity contributes to the facilitation of financial crime and other illicit activities. \nThis first session explored the nuances of the concepts of legal ownership\, beneficial ownership and control and unravelled key concepts in FATF’s Recommendations 24 (and its Interpretative Note) and 25. \nThe group explored the ways in which criminals misuse corporate entities\, looking at real-life examples of how shell companies and opaque and complex ownership chains are abused to\, amongst others\, commit fraud\, be involved in corruption\, hide wealth and launder proceeds of crime. \nAlso discussed were the typical weaknesses in current national BO frameworks\, such as limited powers of BO registers\, striking the balance between the need for privacy and that for transparency\, failures on the part of sectoral supervisors to identify red flags and lack of international cooperation. \nThe topic of implementation in practice wrapped up the session with a debate around what FATF standards mean in practice and how countries can translate them into effective national framework to prevent and detect the misuse of corporate entities. \nIn the coming weeks\, another session will explore approaches to the assessment of BO-related risks at the national level\, translating into practice lessons learnt from this initial session and looking at how to map key issues surrounding the topic in a way that allows jurisdictions to address them. \n???????????????????????? Thank you to all participants for their enthusiastic engagement and the interest expressed by the audience![/vc_column_text][/vc_column][/vc_row]

Analysis is organised by the EU Global Facility and the French Embassy to Jordan. in collaboration with the Anti-Money Laundering Unit of Jordan (AMLU) \nThe workshop\, which is supported by the EU in Jordan\, will bring together\, during three days\, on the one hand\, representatives of these oversight bodies (court of auditors\, inspection services\, anticorruption authorities) and\, on the other hand\, representatives of the justice sector (prosecutions\, criminal courts) as well as a representative of the Financial Intelligence Unit. \nThe countries invited to this regional seminar are Jordan\, Iraq\, Lebanon\, Palestine. \nThe workshop will aim at: \n1) Bringing together players who are often isolated or without much ressources in the face of the complexity of financial crime\, who have not yet acquired this culture of forensic audit and who do not have the necessary inter-institutional synergy.\n2) Strengthening and optimising the means and strategies for combating financial crime and corruption in all its forms affecting public funds and management.\n3) Identifying\, at the end of the exchanges and discussions held in the workshop\, a set of recommendations to strengthen the cooperation both at the inter-institutional level and at the regional level and thus to optimise the practices and strategies implemented by the forensic audit. \nThe logic underlying this workshop is the following: \n1) Analysis of the current situation\, actions and challenges (general and regional of the different actors)\n2) A first solution: forensic audit as an investigation technique for the benefit of the control bodies and authorities\n3) A second solution: forensic audit as a cooperation strategy for the benefit of criminal courts\n4) Regarding the challenges and future threats: recommendations resulting from the discussions of the workshop with an inter-institutional and regional dimension[/vc_column_text][/vc_column][/vc_row][vc_row type=”in_container” I am confident that the discussions at this conference will provide guidance in this direction.” \nThe high level conference will witness the participation of representatives from some of the most important actors in the banking field\, including the International Monetary Fund\, the Wolfsberg Group\, SWIFT\, the Financial Action Task Force (FATF)\, the Egmont Group\, Facebook Payments\, as well as Mauritian financial institutions. \n“The BoM works very closely with all its regulatees to ensure a continuous monitoring of developments on the front of correspondent banking and cross border payments. This workshop is therefore of paramount importance to come out better equipped in view of fostering stronger correspondent banking relationships\,” said Harvesh Seegoolam\, Governor of the BoM. \nFor his part\, David Hotte\, Team Leader of the EU Global Facility\, explained: “The economic impact of de-risking can be devastating for countries around the world. They include difficulties in accessing international payment systems and foreign markets for trade\, closure of operations by institutions\, reduced scale of operations\, and diminished financial performance and job losses.” \nNoting that the number of correspondent banking terminations and restrictions had increased in the ESAAMLG region in recent years\, he added: “with this unique and very high level conference\, we intend to provide answers and solutions to the conclusions of the ESAAMLG survey on correspondent banking relationships.” \nLast year\, Mauritius was removed from both the FATF List of Countries subject to Increased Monitoring ahead of the FATF set timelines and the European Commission List of High-Risk Third Countries. This followed continuous efforts to strengthen the effectiveness of the country’s AML/CFT regime. \n——- \nThe event took place in a hybrid format (onsite and online) in Mauritius\, from 11th to 12th\, May 2022. \nThe objectives of this conference are to assist participants on:\n(a) The de-risking phenomenon in ESAAMLG region\, causes\, consequences\, and main drivers of correspondent banking relationships (CBRs) termination\n(b) The measurement of de-risking impact and of listing\n(c) Describe the FATF (Recommendation 13) and EU best practices\, cross-border correspondent relationships\, as opposed to domestic relationships\, that should prompt additional customer due diligence measures\n(d) Clarify the role of SWIFT as global provider of secure financial messaging services\, and give an overview of the correspondent banking system\, SWIFT’s role and initiatives in financial crime compliance\, and particularly in the ESAAMLG region\n(e) The challenges faced by correspondent banks\n(f) The practical roles\, tools and solutions\, available for supervisors to design and implement risk-based supervision strategies\n(g) The practical expectations\, from the Financial Intelligence Units in receiving\, analysing\, and disseminating suspicious transaction reports on correspondent banking\, and from Law Enforcement agencies in conducting investigations on financial crime abusing correspondent banking relationships (typologies) and the relevant consequences\n(h) Facilitating the exchange of experiences between similar competent authorities[/vc_column_text][/vc_column][/vc_row][vc_row type=”in_container” full_screen_row_position=”middle” column_margin=”default” column_direction=”default” column_direction_tablet=”default” column_direction_phone=”default” scene_position=”center” text_color=”dark” text_align=”left” row_border_radius=”none” row_border_radius_applies=”bg” overflow=”visible” overlay_strength=”0.3″ gradient_direction=”left_to_right” shape_divider_position=”bottom” bg_image_animation=”none”][vc_column column_padding=”no-extra-padding” column_padding_tablet=”inherit” column_padding_phone=”inherit” column_padding_position=”all” column_element_spacing=”default” background_color_opacity=”1″ background_hover_color_opacity=”1″ column_shadow=”none” column_border_radius=”none” column_link_target=”_self” column_position=”default” gradient_direction=”left_to_right” overlay_strength=”0.3″ width=”1/3″ tablet_width_inherit=”default” tablet_text_alignment=”default” phone_text_alignment=”default” animation_type=”default” bg_image_animation=”none” border_type=”simple” column_border_width=”none” column_border_style=”solid”][divider line_type=”No Line” custom_height=”60px”][divider line_type=”No Line” custom_height=”60px”][vc_gallery type=”flexslider_style” images=”2437\,2436\,2434\,2433\,2431″ onclick=”link_no”][/vc_column][vc_column column_padding=”no-extra-padding” column_padding_tablet=”inherit” column_padding_phone=”inherit” column_padding_position=”all” column_element_spacing=”default” background_color_opacity=”1″ background_hover_color_opacity=”1″ column_shadow=”none” column_border_radius=”none” column_link_target=”_self” column_position=”default” gradient_direction=”left_to_right” overlay_strength=”0.3″ width=”1/3″ tablet_width_inherit=”default” tablet_text_alignment=”default” phone_text_alignment=”default” animation_type=”default” bg_image_animation=”none” border_type=”simple” column_border_width=”none” column_border_style=”solid”][divider line_type=”No Line” custom_height=”250px”][nectar_cta btn_style=”see-through” heading_tag=”h6″ text_color=”#009fe3″ button_color=”default” button_border_thickness=”0px” link_type=”regular” alignment=”center” alignment_tablet=”default” alignment_phone=”default” display=”block” display_tablet=”inherit” display_phone=”inherit” link_text=”See more photos” url=”https://dev.global-amlcft.eu/images-videos/”][divider line_type=”No Line” custom_height=”60px”][/vc_column][vc_column column_padding=”no-extra-padding” column_padding_tablet=”inherit” column_padding_phone=”inherit” column_padding_position=”all” column_element_spacing=”default” background_color_opacity=”1″ background_hover_color_opacity=”1″ column_shadow=”none” column_border_radius=”none” column_link_target=”_self” column_position=”default” gradient_direction=”left_to_right” overlay_strength=”0.3″ width=”1/3″ tablet_width_inherit=”default” tablet_text_alignment=”default” phone_text_alignment=”default” animation_type=”default” bg_image_animation=”none” border_type=”simple” column_border_width=”none” column_border_style=”solid”][divider line_type=”No Line” custom_height=”60px”][divider line_type=”No Line” custom_height=”60px”][vc_video link=”https://youtu.be/HqkSRZuZlTk”][/vc_column][/vc_row]

These activities seek to lead to the production of a far-reaching study on existing good practice that alleviate the burden of proof in ML investigations and asset recovery procedures. The results of the study shall provide a valuable resource for the work of relevant global and regional institutions (e.g. FATF\, FSRBs\, EU and UN relevant structures etc.)\, as well as national authorities and justice sectors. \nGeneral Prosecutor of Romania Gabriela Scutea opened the session on Monday\, stating “We need  to help develop new innovative instruments to combat ML and terrorist financing (TF) worldwide. I am trusting that the result of this collaborative work will be helpful and inspire legal practitioners not only here in Romania but also in many countries of the world.” \nFor his part\, EU Global Facility Team Leader David Hotte noted in his opening remarks: “Today\, we need to find a solution to combat ML/TF in an ever more efficient way that is useful for all but also constitutional and in respect of human rights.” \nDuring this specific session\, experts worked to identify\, in their domestic law\, one or several legal mechanisms (legislative provision\, rule established by consolidated case law\, administrative mechanism\, etc.) which facilitate satisfying the reversed burden of proof in ML and cases of illicit enrichment offence. \nPresident of the Siracusa Institute\, Jean-François Thony\, stressed the importance of the matter\, saying “the experts meeting today have one question to answer: how can we improve the fight against money laundering and terrorist financing and how can we ensure that criminals engaging in that kind of activities can be sentenced and deprived of their ill-gotten assets\, within the respect of constitutional rights?” \n“All practitioners know that the difficulty of providing evidence of the offence of money laundering is more acute than for any other crime\, because the essence of this offence is precisely to hide evidence\, to make the trail of illicit profits untraceable\, and to protect criminal assets from confiscation\,” he added. \nThe Experts Working Group is part of a series of activities organised by the EU GF-AML/CFT and the Siracusa Institute aimed at strengthening international judicial co-operation and the efficient application of existing MLA standards and international instruments by judges and prosecutors.[/vc_column_text][/vc_column][/vc_row][vc_row type=”in_container” full_screen_row_position=”middle” column_margin=”default” column_direction=”default” column_direction_tablet=”default”
